Dear Banker,

The upcoming year is shaping up to be one filled with change. The challenge is that we don't know what all the changes will be, yet. In July 2024, FinCEN published a notice of proposed rule making to finally dust off the AML/CFT Priorities from 2021. While we don't have a final rule yet, there will be significant changes to our AML Risk Assessments that will have implications for the other AML Pillars as well.

FinCEN promised that financial institutions would begin having access to the Beneficial Ownership Secure System in May 2025, but FinCEN hasn't told us how, or what we should use it for yet. There is anticipation of a proposed revision to the 2018 Customer Due Diligence Rules, and the industry is waiting with bated breath.

There has been significant enforcement actions in the Fintech and Banking as a Service space which is clearly a warning shot for any financial institution considering partnering with this industry. It's not that regulators are saying it can't be done, but they clearly expect that you have the infrastructure needed to manage the risk. Unfortunately, guidance on third party risk management has been more heavily focused on vendors and less on third party service providers that interact with our customers. The inclusion of delivery channels and intermediaries in the AML/CFT Priorities rule proposal illustrates that there will be continued scrutiny in this area.

All of this means that when prepping your Anti-Money Laundering/Countering Financing of Terrorism (AML/CFT) Program for pending changes, you must make sure your due diligence and monitoring processes are adequate to keep pace with the evolution of suspicious activity.
