Banking has taken a sharp turn since the FDIC last updated its signage rules almost 20 years ago, and the road ahead looks very different. The FDIC’s final rule on Official Signs and Advertising Requirements (12 CFR Part 328) is rerouting how banks comply with parts of the rule already in effect as of May 2025, and other key digital provisions set to engage in March 2026.
Don’t get lost as you switch across three distinct regulatory lanes: updated physical signage requirements, newly required digital signage, and enhanced non-deposit product differentiation signage. This session will provide you with technical specifications and practical examples to synchronize your advertising channels to ensure compliance across every branch, screen and ad. In this session you will learn how to:
- Explore how the rule requires FDIC official signs to be posted in key digital locations, including your website or apps home page, landing or login pages, and deposit transaction interfaces. We will discuss the specifications for continuous display in close proximity to your bank’s name. (Hint: It’s no longer at the bottom of the web page.)
- Learn how to clearly differentiate non-deposit product disclosures, like for mutual funds, annuities, and securities, and distinguish these from FDIC-insured deposits to avoid customer confusion.
- Clarify what remains untouched, including the official advertising statement rules, and avoid the pitfall of overhauling what does not need to change.

Avoiding Unfair, Deceptive or Abusive Acts or Practices (UDAAP) isn’t about checking regulatory boxes. Instead, it requires standing in the shoes of your consumers with an open-minded perspective and operational savvy to anticipate how your products, messaging and processes might negatively affect real people, including vulnerable populations, and potentially result in consumer harm.
The most effective institutions manage UDAAP risks from the top-down and from the bottom-up, embedding UDAAP awareness directly into their organizational DNA. This is no easy task.
